Terms of Use

These Terms of Use ("Terms") apply to your use of www.irinazadok.com (the "Site"), operated by Irina Zadok Gallery ("Irina Zadok Photography," "we," "us," or "our"), and to any purchase you make on the Site. By using the Site or making a purchase, you agree to these Terms. If you do not agree, please do not use the Site.

Use of the Site

You may browse the Site for your own personal, non-commercial use. You agree not to:

  • copy, download, screenshot, scrape, or reuse any images or content from the Site, except files you have purchased and use within your license;

  • remove watermarks, copyright notices, or other identifying information;

  • interfere with the Site's security or operation, or use automated tools to access it; or

  • use the Site for any unlawful purpose.

Products and Delivery

All artwork is sold as high-resolution digital downloads. No physical product will be shipped. You are responsible for printing and framing, including choosing a print shop.

After purchase, a download link is emailed to the address you provide at checkout. The file is available to download immediately, and the link stays active for 24 hours. If your link expires, we can send a new link to the email address used for the original purchase. Please make sure your email address is correct at checkout.

Pricing and Payment

Prices are listed in U.S. dollars and depend on the license tier you select. We may change prices at any time, but changes will not affect orders already placed. Payments are processed securely through Squarespace Commerce checkout by its payment processors. We may refuse or cancel an order, for example if a price was listed in error or we suspect fraud. If we cancel a paid order, we will refund your payment.

Licensing

Every purchase is a license to use a photograph, not a sale of the photograph or its copyright. We offer three license tiers:

  • Residential License: one printed artwork for display in one private residence.

  • Professional / Commercial License: professional large-format printing for one client project, installed in one commercial or professionally designed location.

  • Hospitality / Multi-Use License: multiple printed installations within one approved property or project.

Each license applies only to the specific image, client, property, and use described at the time of purchase. The full inclusions and exclusions of each tier are on our License Artwork page, which forms part of these Terms. Projects involving multiple properties, national brands, extensive reproduction, or enterprise-level use require custom approval and pricing. Please contact us.

Unless you have our written permission, you may not resell, redistribute, share, transfer, or sublicense the digital files. You also may not upload them to stock photography platforms, use them to create products for resale, or use them for another client or project.

Using a file beyond the scope of your license ends your license and may result in legal action.

Intellectual Property

All photographs, text, logos, and other content on the Site are owned by Irina Zadok or Irina Zadok Gallery and are protected by copyright and other intellectual property laws. Copyright and ownership of every photograph remain with Irina Zadok, including after purchase. All rights not expressly granted in a license are reserved.

Refunds

Refunds are covered by our Refund Policy.

Disclaimers

Colors and details can look different on different screens, and final print quality depends on the printer, materials, and size you choose. We are not responsible for the work of third-party print shops or framers.

Except as stated in these Terms and our Refund Policy, the Site and all files are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities, arising from your use of the Site or any purchase. Our total liability for any claim related to a purchase will not exceed the amount you paid for that purchase. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or any use of a licensed image outside the scope of your license.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved in the courts located in Broward County, Florida, and you consent to those courts' jurisdiction.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date and apply to purchases made after that date.
